Definitions

 

​1. “MDS” refers to Metropolitan Driving School Limited.

2. “You” or “Your means you the customer.

3. “Pupil” refers to the person receiving driving lessons.

4. “Instructor” refers to driving instructor who is one of our self-employed franchisees.

5. “Company” refers to metropolitan driving school and its instructors.

6. “Business day”  a day other  than a Saturday, Sunday or public holiday in England, when banks are open for business.

7. “Contract” the contract between the instructor and the customer.

 

8.Data Protection Legislation:  all legislation and regulatory requirements in force from time to time relating to the use of personal data and the privacy of electronic communications, including, without limitation (i) any data protection legislation from time to time in force in the UK including the Data Protection Act 2018 or any successor legislation, as well as (ii) the General Data Protection Regulation ((EU) 2016/679) and any other directly applicable European Union regulation relating to data protection and privacy (for so long as and to the extent that the law of the European Union has legal effect in the UK).

9. Driving Lessons

  • Driving lessons are only available to people who meet the legal criteria

  • Hold a valid provisional or full UK driving licence. Hold a full driving licence issued from any European Union country, or full international driving licence issued from any other country (restrictions apply, 1 year after you became a resident in UK)

10.  Driving Instructors

  • Your driving instructor is a self-employed franchise of MDS.

11. You and Your Instructor Responsibilities

  • It is your responsibility to ensure that you have the appropriate licence, meet all the relevant medical and legal requirements to drive. The licence must be presented to your driving instructor prior to the commencement of your tuition.

  • If you fail to provide valid licence your instructor reserves the right to refuse to provide you with driving lessons and to cancel any lessons you have booked.

  • Your driving instructor is responsible to have the appropriate insurance for you to drive the instructors car during your lessons and the practical test.

  • Your driving instructor is responsible to recommend what is the best in their opinion the most appropriate training methods to help you study your theory and hazard perception test.

  • Your driving instructor is responsible to create lessons plan and advice a course of lessons to match your driving needs.

  • Your driving instructor is responsible to give you relevant feedback, monitor your progress and advice when is the most appropriate time to book your practical test.

  • You and your instructor are responsible for arranging the time date pick up drop off location and duration of your lessons.

 

12. DEALS/OFFERS/BLOCK LESSONS

We offer 10 (block lessons) hours of driving, 30 (intensive) hours of driving, 2 hour Assessment lesson, Pass Plus and Motorway lessons. Once purchased you are committed to the full number of driving lessons offered in your package. If you wish to cancel your package deal you will be entitled to a refund calculated as follows: if the cancellation is made before any lessons are taken we will charge you a £20 administration fee. If the cancellation is made after some lessons have been taken we will charge full price for the lessons taken and £20 administration fee. Please see Refund Policy section.

13. PRACTICAL TEST, PASS PLUS COURSE

To pass the practical test you must be (test standard) able to drive safely in different road conditions. Also you need to show that you know the Highway Code by the way you drive. There is no minimum or maximum number of lessons you must have done before you book and take your test.

  • If your instructor feels that you are not test standard he/she reserves the right to refuse the use of the tuition vehicle for the purposes of taking a practical test.

  • It is your responsibility to advice your instructor of the time, date and test centre of your driving test.

  • It is your responsibility to provide all relevant documents required when taking the practical test.

We are not responsible for any test cancelled by DVSA.

Our test fees are £90 for an automatic car and £90 for a manual car. Pass Plus is practical training course that takes at least 6 hours and is for drivers to improve their skills and drive more safely. It can be taken at any time after passing your practical test. Our 6 hours fees are the following: automatic car £210, manual car £210.

14. Payments, Price changes

  • Payments can be made by using one of the following methods:

  • Payment by credit or debit card to MDS by telephone to our office

  • Online payments through our website

  • Payment by cash, bank transfer direct to your instructor

 

MDS reserves the right to make price changes at any time during the financial year. Metropolitan Driving School accepts no responsibility for any payments made directly to instructors.

 

 15. Cancellations

  • If you want to re-schedule or cancel a driving lesson you must inform your instructor at least 2 working days (known as 48 hours’ notice, excluding Sundays and bank holidays) prior to your driving lesson. If you fail to give the required notice you will be liable to pay the full cost of the lesson.

  • Your instructor will endeavour to give you 2 working days’ notice should a lesson need to be rearranged.

  • The instructor reserves the right to postpone or finish the lesson early if feels that weather or road conditions are dangerous.

  • None of the lessons are transferable.

 

 

16. Refund Policy

 

You can cancel your prepaid lessons at any time. (For individual lessons please see Cancellations section). If you haven’t taken any lessons at the time of cancellation you’ll be entitled to a full refund of any amounts paid to Metropolitan Driving School Limited, subject to the following points:

 

  • If you’ve taken lesson(s) at the time of cancellation you won’t be eligible for a refund on any lessons taken, inclusive the booking fee if applicable.

  • If you are entitled to any refund, you will be required to pay an administration charge of £20 to process the refund. The administration charge will be deducted from each refund that is paid back to you.

  • No refund is payable where a period of 6 months has lapsed since your last lesson.

  • Where it is possible to do so, and we agree to refund you any amounts, we will do so using the same method you used when you made the payment. If for any reason we are unable to refund you using the same method with which you paid, we refund you by any other method we think is appropriate.

  • We may request additional information from you to confirm your identity in order to comply with the Money Laundering Regulations 2007; we will also use this information to ensure adherence to Our Merchant Operating Instructions for card collection facilities.

  • If you paid your instructor for the tuition you want to cancel, your instructor will refund you following the same principles.

  • Refunds may take up to 21 working days to reach you or your account.

 

  17. Limitation of liability

 Your instructor and MDS are not liable for any loss or damage caused where, and to extend that:

  • there is no breach of any legal duty owed to you by the relevant person or body

  • such loss or damage is not a reasonably foreseeable result of such a breach

  • any loss or damage, or increase in the same, results from any breach or omission by you

  • any such loss or damage results from circumstances of natters outside of the reasonable control of the relevant person or body

 Nothing in these terms and conditions will affect any statutory rights you may have as a consumer.

  18. Complaints Procedure

If you have any concerns or complaints, these should be placed in writing .If you have a complaint regarding your Instructor, you should in the first instance discuss any issues that you have with your Instructor.  If the Instructor is unable to resolve any dispute or matter of dissatisfaction, then in the second instance your complaint may be escalated by placing the complaint in writing to:

We reserve the right to update change or replace any part of these terms and conditions by posting updates and changes to our website. It is your responsibility to check our website from time to time for changes.
